The Maine last will and testament, also known as a will, is a legal document that details the testator’s wishes regarding the distribution of their assets, the upbringing of their children, and other matters after their passing. A personal representative, also known as an executor, is a responsible individual appointed to oversee the distribution of the estate in compliance with the terms of the will.

Maine Will Age Requirements

Age Requirements: An individual of sound mind who is 18 or more years of age or a legally emancipated minor may make a will. 1

Maine Will Witness Requirements

Will Witnessing Requirements: The will must be signed by at least 2 individuals, each of whom signed within a reasonable time after the individual witnessed either the signing of the will as described in paragraph B or the testator’s acknowledgment of that signature or acknowledgment of the will. 2

Maine Self-Proved Wills

Any will may be simultaneously executed, attested and made self-proved by acknowledgment thereof by the testator and affidavits of the witnesses, each made before an officer authorized to administer oaths under the laws of the state where execution occurs and evidenced by the officer’s certificate.
