The Massachusetts last will and testament, also known as a will, is a legal document that details the testator’s wishes regarding the distribution of their assets, the upbringing of their children, and other matters after their passing. A personal representative, also known as an executor, is a responsible individual appointed to oversee the distribution of the estate in compliance with the terms of the will.

Massachusetts General Law c.190B Article 2:501 – 2:517

Massachusetts Will Age Requirements

Age Requirements: An individual 18 or more years of age who is of sound mind may make a will. 1

Massachusetts Will Signing Requirements

Will Signing Requirements: The will must be in writing and signed by the testator or in the testator’s name by some other individual in the testator’s conscious presence and by the testator’s direction.

Massachusetts Will Witness Requirements

Will Witnessing Requirements: The will shall be signed by at least 2 individuals, each of whom witnessed either the signing of the will or the testator’s acknowledgment of that signature or acknowledgment of the will. 2

Massachusetts Self-Proved Wills

Massachusetts recognizes self-proved wills. The will must be properly signed and witnessed as well as notarized by an officer authorized to administer oaths in the state.

Revoking A Massachusetts Will

A will can be revoked by the testator creating a new will, by the testator destroying it.
