North Dakota Will Age Requirements
Age Requirements: Any adult who is of sound mind may make a will. (North Dakota Century Code Chapter 30.1-08-01)
North Dakota Will Signing Requirements
Will Signing Requirements: The will must be in writing and signed by the testator or in the testator’s name by some other individual in the testator’s conscious presence and by the testator’s direction.
North Dakota Will Witness Requirements
Will Witnessing Requirements: The will must be signed by at least two individuals within a reasonable time after witnessing either the signing of the will or the testator’s acknowledgment of the signature or of the will. Witnesses are not required if the testator has the will notarized.
North Dakota Self-Proved Wills
North Dakota accepts self-proved wills. The will shall be considered self-proved if it was executed by the testator and witnesses before an officer authorized to administer oaths under the laws of the state in which execution occurs and evidenced by the officer’s certificate, under official seal.
