The Ohio last will and testament, also known as a will, is a legal document that details the testator’s wishes regarding the distribution of their assets, the upbringing of their children, and other matters after their passing. A personal representative, also known as an executor, is a responsible individual appointed to oversee the distribution of the estate in compliance with the terms of the will.

Ohio Revised Code Title 21, Chapter 2107

Ohio Will Age Requirements

Age Requirements: A person who is eighteen years of age or older, of sound mind and memory, and not under restraint may make a will. (Ohio Revised Code Section 2107.02)

Ohio Will Signing Requirements

Will Signing Requirements: Except oral wills, every will shall be in writing, but may be handwritten or typewritten. The will shall be signed at the end by the testator or by some other person in the testator’s conscious presence and at the testator’s express direction. 

Ohio Will Witness Requirements

Will Witnessing Requirements: The will shall be attested and subscribed in the conscious presence of the testator, by two or more competent witnesses, who saw the testator subscribe, or heard the testator acknowledge the testator’s signature. The witnesses must be at least 18 years of age.

Revoking An Ohio Will

A will may be revoked by the testator or someone else in the testator’s presence tearing, canceling, obliterating, or destroying it with the intention of revoking it, or by creating a subsequent will executed in the same manner as the original will.
