South Carolina Will Age Requirements

Age Requirements: An individual who is of sound mind and who is not a minor as defined in South Carolina Section 62-1-201(27) may make a will.

South Carolina Will Signing Requirements

Will Signing Requirements: The will shall be in writing and signed by the testator or signed in the testator’s name by some other individual in the testator’s presence and by the testator’s direction. (South Carolina Code of Laws 62-2-502)

South Carolina Will Witness Requirements

Will Witnessing Requirements: The will shall be signed by at least two individuals each of whom witnessed either the signing or the testator’s acknowledgment of the signature or of the will.

South Carolina Self-Proved Wills

South Carolina recognizes self-proved wills. The will must be signed by the testator and affidavits of the witnesses, each made before an officer authorized to administer oaths under the laws of the state in which execution occurs and evidenced by the officer’s certificate, under official seal.
