The Virginia last will and testament, also known as a will, is a legal document that details the testator’s wishes regarding the distribution of their assets, the upbringing of their children, and other matters after their passing. A personal representative, also known as an executor, is a responsible individual appointed to oversee the distribution of the estate in compliance with the terms of the will.

Virginia Code Title 64.2, Subtitle 2, Chapter 4

Virginia Will Age Requirements

Age Requirements: Any individual who is of sound mind or an emancipated minor, may make a will to dispose of all or part of his estate at his death. (Source: Virginia Code 64.2.401)

Virginia Will Signing Requirements

Will Signing Requirements: No will shall be valid unless it is in writing and signed by the testator, or by some other person in the testator’s presence and by his direction, in such a manner as to make it manifest that the name is intended as a signature.

Virginia Will Witness Requirements

Will Witnessing Requirements: At least two competent witnesses who are present at the same time and who subscribe the will in the presence of the testator.

Revoking A Virginia Will

A will can be revoked by the testator creating a subsequent will or codicil, or by the testator or someone at his direction physically destroying the will. There is also a provision in the law that, if the testator gets divorced after signing a will, any mention of the former spouse shall automatically be revoked.
